Welcome to The Craft Marketplace!

These terms and conditions outline the rules and regulations for the use of The Craft Marketplace Ltd.’s Website, located at www.thecraftmarketplace.co.nz.

The Craft Marketplace is a company incorporated in New Zealand, and these terms apply between you and The craft Marketplace. By registering for an account on this website you are accepting these terms of use. Do not continue to use The Craft Marketplace if you do not agree to take all of the terms and conditions stated on this page. The Craft Marketplace has the right to amend these Terms of Use at any time for any reason. Any amended terms will be effective as soon as they are posted on our website, and as a user it will be your obligation to keep up to date with any new terms. The Craft Marketplace will endeavour to communicate new terms to its users, but if it is unable to do so, the new terms will still apply. You must be 18 to register for an account with The Craft Marketplace which is necessary to buy or sell through the website.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of NZ. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Fees and Commissions

We charge a 5% fee on the completion of your sale, there are no Joining fees, no listing fees. There is also a processing fee from Stripe, of 2.9%+30c.For a $10 item it all adds up to approximately$1.50, therefore we suggest people would list that item for $12 to cover any costs. A $100 item fees add up to approximately $8.20, and a $200 item would be $16.10.

This will be reviewed every 6 months after launch.

Cookies

We employ the use of cookies. By accessing The Craft Marketplace, you agreed to use cookies in agreement with the The Craft Marketplace Ltd.’s Privacy Policy.

Most interactive websites use cookies to let us retrieve the user’s details for each visit. Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.

Unless otherwise stated, The Craft Marketplace Ltd and/or its licensors own the intellectual property rights for all material on The Craft Marketplace. All intellectual property rights are reserved. You may access this from The Craft Marketplace for your own personal use subjected to restrictions set in these terms and conditions.

• Reproduce, duplicate or copy material from The Craft Marketplace
• Redistribute content from The Craft Marketplace

Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. The Craft Marketplace Ltd does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of The Craft Marketplace Ltd, its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, The Craft Marketplace Ltd shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.

The Craft Marketplace Ltd reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.

You warrant and represent that:

• You are entitled to post the Comments on our website and have all necessary licenses and consents to do so;
• The Comments do not invade any intellectual property right, including without limitation copyright, patent or trademark of any third party;
• The Comments do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy
• The Comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.

You hereby grant The Craft Marketplace Ltd a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media.

Hyperlinking to our Content

The following organizations may link to our Website without prior written approval:

• News organizations;
• Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and

These organizations may link to our home page so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party’s site.

If you are one of the organizations listed in paragraph 2 above and are interested in linking to our website, you must inform us by sending an e-mail to The Craft Marketplace Ltd. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to our Website, and a list of the URLs on our site to which you would like to link. Wait 2-3 weeks for a response.

Approved organizations may hyperlink to our Website as follows:

• By use of our corporate name; or

No use of The Craft Marketplace Ltd.’s logo or other artwork will be allowed for linking absent a trademark license agreement.

Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of our Website.

Content Liability

We shall not be hold responsible for any content that appears on your Store. You agree to protect and defend us against all claims that is rising on your Website. No link(s) should appear on any part of the Website that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Reservation of Rights

We reserve the right to request that you remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amen these terms and conditions and it’s linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.

Removal of links from our website

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us any moment. We will consider requests to remove links but we are not obligated to or so or to respond to you directly.

We do not ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the website remains available or that the material on the website is kept up to date.

Lawful

Vendors must endure that the products they are offering for sale conform with all New Zealand laws. Without limiting the generality of this provision, vendors must ensure the following in relation to products offered for sale in their store:

• that all food products comply with the Food Act and any regulations currently in force.
• that products do not breach Trademark or Copyright legislation, or the intellectual property rights of any third party.
• that all products comply with safety regulations in force in New Zealand. Particular care needs to be taken for products sold as suitable for infants under three years old, as there are laws relating to (for example) choking hazards and flammability. However it is the vendors responsibility to ensure all products comply with ALL New Zealand laws.
• the GST inclusive sale price is listed in NZ dollars in the listing for each product. If GST registered this must be shown.
• All vendors are responsible for their own taxes, and must comply with all New Zealand tax laws.

If The Craft Marketplace Ltd has any concerns about the legality of any items offered for sale, it reserves the right to remove the listings immediately and will not relist the items unless it is satisfied, in its own opinion entirely, that the items comply with New Zealand law. The Craft Marketplace Ltd will attempt to communicate with the vendor regarding removing any items from that vendor’s listing. 

The Craft Marketplace Ltd Liability

The Craft Marketplace Ltd takes pride in the integrity of its vendors and endeavours to ensure their honesty and responsibility. However, The Craft Marketplace Ltd assumes no liability, including negligence:

• For the quality, suitability, accuracy of description, or legality of products sold by vendors.
• In case a vendor fails to deliver a product.
• If a buyer fails to make payment for a product.
• For ensuring the safety of any product.
• If a refund is required it is the vendors responsibility to make a refund or replace their product, depending on their own store policy.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

• limit or exclude our or your liability for death or personal injury;
• limit or exclude our or your liability for fraud or fraudulent misrepresentation;
• limit any of our or your liabilities in any way that is not permitted under applicable law; or
• exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.

Vendors responsibilities

The Craft Marketplace website is a marketplace for goods made in New Zealand we welcome New Zealand makers to open an account with us to sell any items the seller has personally been involved in making or designing. The Craft Marketplace may remove listed items or close sellers’ accounts if the goods offered are not, in our sole and unfettered discretion, items associated in this way with the seller. The Craft Marketplace will always attempt to discuss this with the seller first. There is room for discussion as to whether articles are sufficiently associated with the seller. Generally, but without affecting The Craft Marketplace absolute discretion, an admissible article will have one or all of the following qualities:

• it is an original design, designed by the seller
• it has been mostly made by the seller
• it has factory made components, but these are assembled by the seller in a creative and or unique way,
• though originally factory made, it has been upcycled, reconditioned or repurposed by the seller substantially.

• Vendors must provide a valid New Zealand address and phone number.

Duplicate listings of the same item are considered spam and excessive identical listings will be removed. Listing fees are not refundable in this instance. Multiples of an item can be listed using the variable field.

Items listed in inappropriate categories will be moved to a suitable category or removed at The Craft Marketplaces discretion. Listing fees are not refundable in this instance.

All sales arising from a buyer enquiry or contact through this website are subject to a commission payment as set out in the commission rates applicable at the current time.

To support this The Craft Marketplace requires that sellers do not post their contact details, including website details and links on the website or contact buyers outside of the The Craft marketplace sale process for the purposes of concluding a sale. Sellers may not make arrangements through the The Craft Marketplace website, or with our buyers, to conclude a sale outside The Craft Marketplace system for sales. If The Craft Marketplace becomes aware that this has occurred, it will take action against the seller, which may include claiming any lost commission and terminating the seller’s account.

Vendor information

Please make sure you supply correct current information to The Craft Marketplace, including your personal details and correct payment details. It is your responsibility to update these details any time they change. The Craft Marketplace will not be responsible for any losses caused to you due to your failure to provide correct and updated personal information and payment details.

To ensure that active shops are monitored, you are required to log in to The Craft Marketplace on a regular basis while you have listings that are visible to the public.
